NEW CLASS ACTION AIMS TO DEODORIZE A NUISANCE IN
GARFIELD HEIGHTS

OHIO (Dec. 18, 2015) Thomas J. Connick of Connick Law, LLC and solo practitioner
Edward Cochran were named as plaintiffs’ lead counsel in an Order certifying class action
Thursday in Cuyahoga County’s Court of Common Pleas.

The class area in Berdysz, et al., vs. Boyas Excavating, Inc., et al., CASE NO.: CV-14-826410,
focuses on the City View Center Property (CVC) in the City of Garfield Heights, which is also a
named defendant. The motion alleges that nuisance odors emanating from a landfill on the site
diminished plaintiffs’ property values and interfered with the enjoyment of their homes and land.

“This major development potentially impacts hundreds of residents, the air they breathe and their
respective property values,” said Tom Connick. The principal of his firm, Mr. Connick has
recovered multiple millions of dollars for his plaintiff clients harmed in matters stemming from
personal injury, wrongful death, property damage claims and insurance bad faith matters.
“The plaintiffs have endured environmental inconveniences that could have been avoided. We
plan to prove that their decreased property values are a direct result of the City’s actions,” he
added.

Located along the eastern edge of Transportation Boulevard, the CVC Property has housed two
landfills. In 2005 the land was developed into a once-promising shopping center that now has
mostly vacant storefronts, but continues to negatively impact surrounding residents.
